Did you check on quickserve by ESN what is the factory config for this engine?

I might be looking up something wrong, but https://parts.cummins.com offers turbo speed sensor and egr parts for this engine. Even without parts catalog we can tell 100% that this turbo is not from factory!!! We are talking about 2.5 year old engine, I see no reason why turbo would need to be replaced. Factory engine parts are painted over, even the sensors are. Are you absolutely sure that this is pre emissions? Most likely some moron has done an engine killing demandate + VGT delete to kill it even faster.

VGT turbo is more effiecient but it costs more, even though in the long run it will literally pay off fuel savings wise.

In Aussie market there may be no egr, but there still has to be SCR and other kinds of emissions.

Let's pretend that this has no emissions from factory, in this case what usage application allows that? Firetruck or military or off road only or something completely else??
